This website and video training platform are owned and operated by the Managing Director of GEM Compliance Training Ltd. 1. The contract between us

Payment of the price for the services represents an offer on your part to purchase the services, which will be accepted by us only when a confirmation of acceptance is sent by us. Only at this point is a legally binding contract created between us.

2. Acknowledgement of your order

To enable us to process your order and access our services, you will need to provide us with your full name, e-mail address, workplace name (if applicable) and contact number. We will notify you by e-mail as soon as possible to confirm receipt of your booking and to confirm full details of your course booking.

3. Ownership of rights

All rights, including trade mark and copyright, in this website are owned by or licensed to GEM Compliance Training Ltd. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose. All intellectual property rights in all materials available from GEM Compliance Training Ltd, including the design, graphics and text of all printed materials are wholly owned by GEM Compliance Training Ltd.

All content included in or made available through any GEM Compliance Training Ltd, such as text, graphics, logos, button icons, images, video content, audio clips, digital downloads and data compilations is the property of GEM Compliance Training Ltd or its content suppliers and is protected by UK and international copyright, authors’ rights and database right laws. The compilation of all content included in or made available through GEM Compliance Training Ltd is the exclusive property of GEM Compliance Training Ltd and is protected by UK and international trademark, copyright and database right laws.

4. Accuracy of content

We have taken care in the preparation of the content of this website and video training platform, in particular to ensure that prices quoted are correct at the time of publishing and that all services have been described accurately.

5. Damage to your computer

We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and the video training platform. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website and the video training platform.

6. Availability

The services will be provided within an agreed timescale, and time is not of the essence of the contract.

7. Ordering errors

You are able to correct errors on your booking up to the point on which you click on “submit” during the ordering process.

8. Price

The prices payable for our training services that you order are as set out on our website. All prices are exclusive of VAT which shall be payable by the client at the appropriate rate.

9. Payment terms

We will take payment upon receipt of your order for our training services alternatively at request we can raise and send an invoice which will become payable 7 days prior to the training course commencing. We accept no liability if our services are delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the training services from you, then we can refuse to process your order and/or suspend any further services. This does not affect any other rights we may have.

10. Certificates

Certificates will only be released upon receipt of full payment of the training services provided. Certificates are emailed/posted to the person who has booked and paid for the course. If a replacement regulated certificate is requested after the original regulated certificate has been issued there is a cost for this service from our awarding bodies.

Upon completion of our video training completion certificates will be available for electronic download.

11. Cancellation rights

11.1 If a client wishes to cancel or transfer to another course, for any reason, we reserve the right to recover fees if notification of cancellation is less than 7 days from the commencement date of the training course. A suitable substitute delegate may be provided at no extra cost.

11.2 If the training services that are arranged exclusively for the client are cancelled or postponed at the request of the client, we reserve the right to recover fees if notification of cancellation is less than 7 days from the commencement date of the training course.

11.3 At the company's discretion, we may agree to transfer a course place up to a maximum of 3 times. After this period, a transfer may still be made, but would incur an additional course place fee.

11.4 Where training services that are arranged exclusively for the client are cancelled or postponed at the request of the client more than 7 days from the commencement date of the training course, we reserve the right to retain a non-refundable and non-transferable deposit of 30% of the total value of the training course.

11.5 Should you wish to cancel your order, you can notify us in writing to GEM Compliance Training Ltd, 29 Chapel Street, Bradford, BD1 5DT or by emailing us on info@gemcompliancetraining.co.uk

12. Cancellation by us

12.1 We reserve the right not to process your order if:

12.1.1 We have insufficient staff or resources to deliver the services you have ordered;

12.1.2 We do not provide services to your area; or

12.1.3 One or more of the services you ordered was listed at an incorrect price due to a typographical error.

12.2 If we do not process your order for the above reasons, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit/debit card as soon as possible, but in any event within 14 days.

13. If there is a problem with the services

13.2 We are under a legal duty to supply services that are in conformity with this contract and in accordance with the Consumer Rights Act 2015 (the Act).

14. Liability

14.1 We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions. We do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) does or fails to do, or is due to events which are beyond our reasonable control.

14.2 Furthermore, we do not accept liability for any losses related to any business of yours including but not limited to: lost data, lost profits, lost revenues or business interruption.

14.3 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

14.4 GEM Compliance Training Ltd does not accept responsibility for anyone acting as a result of any information in, or views expressed on, its training courses; including any course materials. Opinions expressed are those of individual trainers and not necessarily those of GEM Compliance Training Ltd. Participants are advised to seek professional advice when dealing with specific workplace situations.

15. Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our email address at info@gemcompliancetraining.co.uk and all notices from us to you will be displayed on our website from time to time.

16. Changes to legal notices

We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

17. Law, jurisdiction and language

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

18. Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

19. Privacy

You acknowledge and agree to be bound by the terms of our privacy policy further below.

20. Using your data

We will only use the information you provide us with to send you email and/or conventional mail about your training interests or purchases to keep you informed of new developments and approaching the anniversary of your course as a reminder and for refresher training marketing purposes. For quality and research purposes we may occasionally use your information to make telephone calls in relation to our courses and to verify administration arrangements.

We use this information to help us understand more about how our web site is used, to improve our site, and to send you information either electronically or otherwise, about us and our products which we think may be of interest to you.

We will not pass nor sell your personal information to any third party.

Links connecting this website with other websites are for convenience and advice only and do not mean that GEM Compliance Training Ltd endorses or approves those linked websites, their content or any changes or updates to such sites.

22. Referral Programme

  • The referrer must have attended a course with GEM. Following the referrer's attendance, the person you refer must book and attend a GEM course afterwards.
  • The person you refer must use both the promotional code and the referral code when booking on a course through our website, This is how we track referrals back to the referrer and the person you refer receives their 10% discount.
  • As the referrer, you will receive an Amazon gift voucher for each new customer you have referred who has booked and attended a GEM course.
  • Referral programme rewards do not count for referrals that may have been made prior to the launch of the programme which was 20/03/2023.
  • This referral programme cannot be used in conjunction with one of our products or services that has already been discounted.
  • All prices stated here are exclusive of VAT.
  • Referral accounts that are cancelled by GEM for any reason (non-compliance with GEM’s Customer Terms) will not be included in the programme.
  • GEM reserves the right to terminate a user’s involvement in the programme if GEM suspects that there is misuse of the programme.
  • GEM may amend these terms and conditions at anytime. Revised terms and conditions shall become effective immediately upon publishing.
  • GEM reserves the right to amend, suspend or cancel the programme at any time.

23. Unsubscribe
